These Terms and Conditions ("Terms") apply to all orders and services provided by Tsunami Print ("we," "our," or "the Company") to individuals or entities ("you," "your," or "the Customer") within the state of Utah. By placing an order or engaging in our services, you acknowledge and agree to comply with these Terms.

2. Services and Products

Tsunami Print specializes in high-quality printing services. We offer a variety of printing options, which may change or be updated periodically. All product specifications, such as materials, colors, and designs, are subject to availability and may vary slightly from those depicted on our website.

3. Order Placement and Acceptance

Order Submission: All orders must be submitted via our website, email, or physical store. Orders are considered final upon submission, and any adjustments may incur additional fees.
Order Acceptance: Upon receipt of an order, Tsunami Print will review it for accuracy and availability. We reserve the right to accept or decline an order at our discretion.
Cancellations: Orders can be canceled within 24 hours of placement without incurring a fee. After 24 hours, a cancellation fee may apply based on production stage.

4. Payment Terms

Pricing: Prices for all services are listed on our website and may be updated without prior notice. Any quotes provided are valid for 30 days.
Payment Methods: We accept major credit cards, debit cards, and other approved payment methods. Payment is required upon order confirmation unless a specific payment arrangement is approved in writing.
Refunds: Tsunami Print offers refunds only for products that fail to meet the agreed-upon specifications. Refund requests must be made within 14 days of receiving the product.

5. Intellectual Property

All content, designs, and trademarks provided by Tsunami Print are the property of the Company and protected by intellectual property laws. Customers are prohibited from reproducing or distributing our materials without prior written consent. When submitting your own content (e.g., designs, logos), you represent that you hold all necessary rights and permissions to use such content.

6. Liability and Limitations

Product Guarantee: Tsunami Print guarantees quality products as described. However, slight color and material variations are possible and do not qualify as defects.
Limitations of Liability: To the extent permitted by Utah law, Tsunami Print will not be liable for any indirect, incidental, or consequential damages arising from your use of our products or services. Our total liability will not exceed the total cost of your order.
Customer Responsibility: You are responsible for reviewing proofs, specifications, and any necessary corrections prior to final production. Tsunami Print is not liable for errors not identified and corrected by the Customer.

8. Governing Law and Dispute Resolution

10. Client Responsibility and Design Review

Client-Provided Design: Tsunami Print provides printing services based on the files and designs supplied by clients. By uploading a design or file for printing, the Client acknowledges and accepts full responsibility for the content, including spelling, grammatical, graphical, or any other errors within the design.
File Review: It is the sole responsibility of the Client to review and verify all aspects of their design before confirming the order. Tsunami Print does not automatically correct or proofread content in files provided by the Client. This includes, but is not limited to, verification of text, graphics, spelling, punctuation, colors, and dimensions in the design.
Limitation of Liability: Tsunami Print is not liable for errors in files or designs provided by the Client. Once the order is confirmed, any errors in the uploaded file are solely the Client’s responsibility. If the Client requests a reprint due to their own errors in the design, Tsunami Print may, at its discretion, offer a discount on the reprint order but is not obligated to cover the full cost of such reprinting.
Design Rights: By submitting a design, the Client represents that they hold all necessary rights for its use and that the design does not infringe upon any third-party rights. The Client assumes full responsibility in case of any claims regarding copyright, trademarks, or any other infringement arising from the provided content.

Exclusion of Liability for Client Errors: By accepting these terms, the Client understands that Tsunami Print is limited to printing files as they are provided at the time of upload and confirmation, without modification. Any error in the final product resulting from incorrect, incomplete, or inaccurate files supplied by the Client shall not be the responsibility of Tsunami Print.
